| By enrolling as a participant in the Associate
Member Program you agree to the following terms and conditions:
Parties
You as the participant in
The Associate Member Program, hereinafter are known as Participant.
McCann & Cambrian E-Media
Services is hereinafter known as MCES.
The Associate Member Program
is hereinafter known as AMP.
Remuneration
Remuneration is based on
finder's fees and/or commissions. More information will be posted
here. Presently we invite you to contact
us for complete details.
Corporate Image, Ethics
& Customer Approval
The Associate shall exercise
integrity and professional manner in representing MCES. The Associate
may not involve, promote, or represent MCES in connection, or association
with any product or service which provides any content or references to
such content that includes but is not limited to pornography, foul language,
hate propaganda, anything illegal, mail fraud or pyramid schemes, slander,
libel or defamation, publicizes the personal information or likeness of
a person without that person's consent, violates the privacy rights of
any person, advocates any undermining of human rights, threatens persons
with bodily harm, harassing, or abusive statements or messages, or solicitation
of any acts or services that are illegal under applicable law.
MCES retains the sole right
and discretion to refuse a referral if it is determined that the referral
would be considered to be in violation of Our
Policies And Terms of Service.
Our Polices And Terms of
Service govern the Associate Member Program. In the event a referral
is found to be in violation of any of MCES policies and terms of service,
MCES reserves the right to cancel service to the said referral and the
referring Associate agrees to forfeit any future earnings in association
with the canceled account(s).
Associate Registration
& ARN
The Associate's registration
and Associate Rep Number (ARN) are nontransferable.
Marketing Material
Marketing material including
but not necessarily limited to brochures, posters, ad copy and Associate
Rep Number cards may be made available when and where possible. MCES
does not warrant that any or all such marketing material is unconditionally
available, but MCES will make every fair attempt to oblige Associates'
reasonable requests for such.
Banners and Text Links are
made available for inclusion on an Associate' web site(s) if so requested
by the Associate. A mirror site will be made available for Associate's
referrals to register on line.
MCES will make reasonable
attempts to work with the Associates in helping to market MCES products
and services.
Indemnification
MCES does not warrant that
any service rendered under the AMP will be uninterrupted or error free.
No such service warrants any results directly or indirectly from use of
the service or from any content associated with such service. All
components of the AMP are provided on an "as is, as available" basis.
The Participant agrees not
to hold MCES responsible for any errors, inaccuracies, corrupted downloads
or faulty media and the Participant agrees not to hold MCES responsible
for any damage, financial or other, which may arise from such.
The Participant agrees to
indemnify, defend and hold MCES and any of its affiliates harmless from
any and all claims, losses, damages, costs and expenses (legal and otherwise)
and any liability incurred as a result of the use or misuse of MCES services.
MCES reserves the right entirely,
to change or modify any or all provisions of this Agreement at any time,
without notice, effective immediately. MCES will however attempt
to provide reasonable advance notice of any such modifications which may
or may not affect the Participant.
The Participant acquires
no ownership rights of any kind in any written material, logos, business
name, brand name belonging to MCES and the Participant shall not make any
such representations of ownership.
The Participant is free to
cancel this agreement at any time.
MCES reserves the right to
cancel this agreement at any time it may deem that the Participant has
violated any part of this agreement or misrepresented MCES in any way.
This agreement shall be issued
and governed pursuant to provisions recognized and enforced under local
law.
